ONENSIX Location-Based Service Terms of Service

Article 1 (Purpose)

The purpose of these Terms is to define the rights, obligations, and responsibilities between ONENSIX (hereinafter referred to as "Company") and members regarding the use of location-based services (hereinafter referred to as "Services") provided by the Company.

Article 2 (Effectiveness and Amendment of Terms)

① These Terms become effective when a customer or personal location information subject who has applied for the Service agrees to these Terms and registers as a user of the Service according to the procedures established by the Company.

② When a member clicks the "Agree" button for these Terms online, it is deemed that they have read all the contents of these Terms, fully understood them, and agreed to their application.

③ The Company may revise these Terms within the scope that does not violate relevant laws such as the Location Information Protection and Use Act, Content Industry Promotion Act, Consumer Protection Act in Electronic Commerce, Framework Act on Consumers, and Act on the Regulation of Terms and Conditions.

④ When the Company revises the Terms, it shall notify the effective date and reasons for revision along with the current Terms from 7 days before to the day before the effective date of the revised Terms. However, for changes that significantly affect members' rights and obligations, notice shall be given 30 days in advance.

⑤ Members have the right to refuse the changed Terms. Members may express their intention to refuse within 15 days of the notice of the changed Terms. If a member refuses, the Company may terminate the contract with that member after giving 15 days' advance notice. If a member does not express refusal or uses the Service after the implementation date, it is considered that they have agreed.

Article 3 (Application of Related Laws)

These Terms shall be applied fairly in accordance with the principle of good faith, and matters not specified in these Terms shall be governed by relevant laws or commercial practices.

Article 4 (Service Content)

The services provided by the Company are as follows:

Location-Based Services
Recording and storing places using current location
Uploading memos and photos of visited places
Providing visit history timeline
Displaying current or specific locations on a map
Managing visit records based on saved locations
Searching nearby places using current location

Article 5 (Service Usage Fees)

① The services provided by the Company are basically free, and for separate paid services, you must pay the fees specified in the relevant service to use them.

② The Company may charge paid service usage fees through methods determined by electronic payment companies contracted with the Company or by adding them to bills determined by the Company.

③ Cancellation and refund of payments made through paid service usage shall be governed by the Company's payment terms and related laws.

④ Refund requests due to personal information theft and payment fraud, or requests for personal information of payers may be refused except as provided by law.

⑤ Data communication charges incurred when using wireless services are separate and subject to the policies of each mobile carrier.

Article 6 (Notice of Service Content Changes)

① When the Company changes or terminates service content, the Company shall notify members of service content changes or termination by email to the members' registered email addresses.

② In the case of paragraph ①, when notifying an unspecified number of people, the Company may notify members through the website or other Company announcements.

Article 7 (Restriction and Suspension of Service Use)

① The Company may restrict or suspend a member's service use when any of the following reasons occur:

When a member intentionally or with gross negligence interferes with the operation of the Company's services
When unavoidable due to service facility inspection, maintenance, or construction
When a telecommunications business operator prescribed in the Telecommunications Business Act has suspended telecommunications services
When there are obstacles to service use due to national emergencies, service facility failures, or excessive service usage
When the Company deems it inappropriate to continue providing services due to other serious reasons

② When the Company restricts or suspends service use pursuant to the preceding paragraph, it shall notify the member of the reason and restriction period.

Article 8 (Use or Provision of Personal Location Information)

① The Company may use members' location information to provide services, and members are deemed to have consented to this by agreeing to these Terms.

② The Company automatically records and preserves location information use and provision fact confirmation data for fee settlement and complaint handling with other business operators or customers, and such data is kept for one year.

③ When the Company provides personal location information to third parties designated by members, it immediately notifies members of the recipient, provision date and time, and purpose of provision through the communication terminal device that collected the personal location information.

④ When the Company intends to use members' personal location information or location information use and provision fact confirmation data beyond the scope specified or notified in the terms of use or provide it to third parties, it must obtain members' consent.

Article 9 (Rights of Personal Location Information Subjects)

① Members may withdraw all or part of their consent to the provision of location-based services using personal location information and the provision of personal location information to third parties from the Company at any time.

② Members may request the Company to temporarily suspend the use or provision of personal location information at any time, and the Company cannot refuse this and must have technical means for this.

③ Members may request the Company to view or notify the following data, and if there are errors in such data, they may request correction. In this case, the Company cannot refuse the member's request without justifiable reasons.

Reasons and contents of their personal location information being provided to third parties under the Location Information Protection and Use Act or other legal provisions

Article 10 (Retention Purpose and Period of Personal Location Information)

① The Company retains and uses personal location information for the minimum period necessary to provide location-based services according to Article 4 of these Terms.

② The Company uses personal location information on a one-time or temporary basis in all location-based services and destroys it without delay.

Article 11 (Designation of Location Information Manager)

① The Company designates and operates a location information manager who is in a position to take substantial responsibility for properly managing and protecting location information and smoothly handling complaints from personal location information subjects.

② The location information manager is the department head of the department providing location-based services, and specific matters are governed by the addendum to these Terms.

Article 12 (Damages Compensation)

① If damage occurs to members due to the Company's violation of Articles 15 to 26 of the Location Information Protection and Use Act, members may claim damages compensation from the Company. In this case, the Company cannot be exempted from liability unless it proves absence of intent or negligence.

② If damage occurs to the Company due to a member's violation of these Terms, the Company may claim damages compensation from the member. In this case, the member cannot be exempted from liability unless they prove absence of intent or negligence.

Article 13 (Exemption)

① The Company shall not be liable for damages incurred to members when services cannot be provided due to the following reasons:

Natural disasters or equivalent force majeure situations
Intentional service interference by third parties who have entered into service partnership agreements with the Company for service provision
Service use obstacles due to members' own fault
Other reasons excluding items 1 to 3 above that are not due to the Company's intent or negligence

② The Company does not guarantee the reliability, accuracy, etc. of services and information, data, and facts posted on services, and shall not be liable for members' damages arising therefrom.

Article 14 (Application of Regulations)

These Terms are governed and implemented by Korean law.

Article 15 (Dispute Mediation and Others)

① The Company may apply for adjudication to the Korea Communications Commission when disputes related to location information cannot be resolved through consultation between parties or when consultation is impossible.

② The Company or customers may apply for mediation to the Personal Information Dispute Mediation Committee when disputes related to location information cannot be resolved through consultation between parties or when consultation is impossible.
